Your privacy is of the utmost importance to Smoke & Mirrors Mysteries LLC (referred to as the "Company”, “SMM”, “we”, “us” “our”), and this document was created to help you better understand our practices regarding Personally Identifiable Information (“PII”), or information that can be used alone or in conjunction with other data to identify or contact you. This policy may refer to you as our “customer”, “user”, or simply “you” and is written regarding PII for any/all of our Sites (such as the website, mobile application, social media channels, email, or any other portals, communication avenues, or services – the “Sites”). By registering with the Company or providing PII through our Sites or a result of the services and/or goods you use, interact with, or communicate with or through, you represent that you consent to the collection, use, and disclosure of your PII in accordance with this Privacy Policy. By using our Sites, services, and/or goods, you consent to our Privacy Policy.

 

SUMMARY

  • The Company does not request unnecessary PII. 

  • This Privacy Policy describes the data we may collect as well as how it may be collected as related to our services, goods, and Sites. 

  • PII may be collected by the Company. Anonymous Data may be collected or created by the company. 

  • The type of PII collected varies depending on what you view or interact with on our Sites as well as what services and/or goods you purchase and/or use.

  • The PII we collect may include data you provide to us directly via our Sites or through usage of our services and/or goods as well as automatically collected information. 

  • Your PII as well as anonymous data may be used to enhance and customize the services, goods, and Sites, for marketing, to monitor and analyze utilization of our services, goods, and Sites, and/or to provide customer care and service regarding inquiries.

  • We may communicate with you for marketing purposes (for example, other services, goods, or Sites owned by the Company which we think may be of interest to you or to promote special deals or promotions for the Company).

  • We do not share or sell your PII to third party companies for the sole purpose of allowing them to market a service, good, or site not owned by the Company. 

  • We do not share PII with anyone except to develop and sell our products, process payments, comply with legal requirements, and/or to protect our rights.

 

TYPES OF INFORMATION

We receive, collect and store any information you enter on our Sites or provide Us in any other way, including when you interact with our Sites, if you register on our Sites or register to use our services or goods, and when you use our services or goods. We may also collect information that is not PII, or Anonymous Data, meaning it is not linked to or the same as the aforementioned data and cannot be used by itself to identify individual persons.  In addition, we may collect the Internet protocol (IP) address used to connect your computer to the Internet, credentials such as login, email address, password, computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect PII (including name, email, date of birth, password, communications), payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.

 

HOW INFORMATION IS COLLECTED

When you conduct a transaction on our Sites, as part of the process, we collect personal information provided by you such as your name, address, date of birth, address, and email address. Your personal information will be used for the specific reasons stated below:

 

DATA PROVIDED BY YOU

  • ACCOUNT INFORMATION – We may collect PII from you (first and last name, email address, phone number, login and password) when you create or log into an account on our Sites. We may also collect your information about your interactions with the Sites or services or goods (including products or subscriptions your purchase or view) and information about the advertising you receive through the Sites, services, or goods.

  • PAYMENT – If you choose to purchase and pay for services or goods (whether for yourself or someone else), we must collect the necessary information to complete the transaction (your name, credit card information, billing information). 

  • GENERAL – Information voluntarily provided or disclosed by you (entering of contests, competitions, surveys, user forums, chat forums or social media functions, or any other reasons for or modes of providing PII to us).

  • CONTACT US – When you contact Us for feedback, input, questions, or help via our Sites or any other method, we collect your name and email address plus the content included in your communication or message so that we may send you a response.

  • USER CONTENT – If you upload or share any comments or other content to any of our Sites, we may collect that information – including  any PII you included. 

 

AUTOMATICALLY COLLECTED DATA

In order to make our services, goods, and Sites the most beneficial, useful, and of the highest customer experience to you, we may collect data systematically. This may include but is not limited to:

  • your IP address

  • browser type

  • operating system

  • domain name

  • date/time stamp for your visit

  • referring/exit pages

  • clickstream data

  • generated device identifier information

  • number of times you visit our Sites and amount of time spent using the Sites, services, or goods

  • if you access the Sites, services, or goods via a third-party account like Google, Facebook, or other similar channel

This data allows us to analyze trends, understand user movement around the Sites, gather demographic information about our user base, and enhance our services, goods, and Sites to better suit your needs. 

 

INFORMATION FROM OTHER SOURCES

The Company may obtain data about you from other sources and combine it with information we collect directly from you (for instance, if you post content to our pages or feeds via a third-party social media channel or if you use credentials on a third-party site to create or log into your Smoke & Mirrors Mysteries LLC account).

 

COOKIES

We may also use cookies to collect information, including both session cookies (expire when you close your browser) and persistent cookies (stay on your computer until you delete them). Cookies are small files that a site or its service provider transfers to your computer hard drive via your web browser, enabling the site or service provider to recognize your browser and collect and remember certain information. Cookies allow us to provide a more personalized, interactive experience on our Sites. They also allow us to remember your shopping cart, recognize and save your preferences, and compile aggregate data about site traffic and interaction to enhance the site experience in the future. We may partner with third party service providers to more fully analyze our Sites traffic; these providers are not allowed to use the information collected on behalf of the Company outside the scope of assisting us with conducting and improving our business.

  • provide improved administration of our services and goods

  • process transactions and provide the services and goods you request

  • improve the experience when you interact with our services, goods, or Sites

USER TESTIMONIALS

If you send us a testimonial about our services or goods, we may use and disclose it (including your first name) at our discretion as we see fit. However, we will obtain your consent prior to posting your full name along with the testimonial.  

 

CREATION OF ANONYMOUS DATA

We may create Anonymous Data records from PII by excluding information (such as your name) that makes the data personally identifiable to you. We use this Anonymous Data to analyze usage patterns so that we may enhance our services and goods and improve navigation of the Sites. We reserve the right to use Anonymous Data for any purpose and disclose Anonymous Data to third parties at our discretion.

 

DISCLOSURE OF PII

We may disclose your PII as outlined below and as described elsewhere in this Privacy Policy:

  • THIRD PARTY SERVICE PROVIDERS – We may share your PII with vendors, consultants, or other service providers in order to provide you with the services and goods that we offer to you through our Sites, to conduct quality assurance testing, to facilitate creation of accounts, and to provide technical support. These providers must agree to keep this information confidential and only use it within the scope outlined in this Privacy Policy.

  • OTHER THIRD PARTIES – If you interact with us or participate in interactive areas of the Sites or via a third-party social media channel, certain pieces of information may be publicly visible (name, photos, or other data you choose to share)

  • AFFILIATES – We may share some or all your PII with our subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), in which case we require our Affiliates to honor this Privacy Policy. 

  • CORPORATE RESTRUCTURING – We may share some or all your PII in connection with or during negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of an insolvency, bankruptcy, or receivership, PII may also be transferred as a business asset. If another company acquires our shares, business, or assets, that company will possess the PII collected by us and will assume the rights and obligations regarding your PII as described in this Privacy Policy.

  • OTHER – Regardless of any choices you make regarding your PII (as described below), the Company may disclose PII in connection with any legal investigation, to comply with relevant laws or to respond to subpoenas or warrants served on the Company, if we believe your actions are non-compliant with the Company Terms and Conditions or other policies, to protect or defend the rights or property of the Company or users of the services and goods, and/or to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms and Conditions.

Additionally, the Company may share non-PII or aggregated data, meaning it cannot reasonably be used to identify you. 

 

THIRD PARTY LINKS

We may at times include or offer third party services or goods via our Sites. It is important to note any third-party sites have their own separate and independent privacy policies and the Company has no responsibility or liability for the content and/or activities of these linked sites. 

 

SOCIAL MEDIA SHARING

The Company may post links to social media sites (Facebook, Twitter, or other similar sites). Your use of such features enables the sharing of information with your friends and possibly the public, dependent upon the features and settings you have established with these social media entities and set up in your own individual social media accounts. Please visit the privacy policies of these entities, as they each have their own individual and unique privacy policies separate from that of the Company.

 

YOUR OPTIONS REGARDING INFORMATION

You have several choices regarding the use of information as it relates to our Services, Goods, and Sits:

  • EMAIL – We may periodically send you free newsletters and emails that directly promote the use of our services and goods. You may indicate a preference to stop receiving further communications from us, and you will have the opportunity to “opt-out” by following the instructions provided in the email you receive or by contacting us directly at help@smmysteries.com. Despite your indicated email preferences, we may send you service-related communications, including notices of any updates to our Terms and Conditions or Privacy Policy.

  • COOKIES – If you decide at any time that you no longer wish to accept Cookies from our Sites for any of the purposes described above, you can change your browser settings to stop accepting Cookies or to prompt you before accepting a Cookie from the websites you visit. Consult your browser’s technical information. If you do not accept Cookies, you may not be able to use all portions of the service, goods, or Sites or all functionality of the service, goods, or Sites. 

  • MAINTAINING YOUR PII – You may change any of your contact information in your Account by editing your profile within your Account or by sending an email to us at help@smmysteries.com. You may request deletion of your PII by us and we will use commercially reasonable efforts to honor your request, but please note that we may be required to keep such information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database but may remain in our archives. We may also retain your information for fraud or similar purposes. 

  • CALIFORNIA RESIDENTS – California law permits California residents to request certain details about how their information is shared with third parties for direct marketing purposes. If you are a California resident and wish to receive this information, you may do so once per calendar year by emailing the us at help@smmysteries.com. The Company is required to respond to one request per California customer per year. 

 

SECURITY OF YOUR PII

The Company is committed to protecting the security of your PII and preventing unauthorized access, use, or disclosure of it. Our website is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.  

 

All direct payment gateways offered by Wix.com and used by the Company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Additionally, we also may require you to enter a password to access your account information. Please do not disclose your account password to anyone. Also be aware that there is absolutely no method of transmission over the Internet or method of electronic storage that is 100% secure. This means that while the Company uses reasonable efforts to protect your PII, the Company cannot guarantee its absolute security or that it will not be intercepted during transmission to or from us over the Internet.

 

INTERNATIONAL TRANSFER OF DATA

We do not intentionally offer, market, target, or direct our products to people living outside of the United States of America (USA). The Company is based in the USA, and information collected by us is governed by USA law. However, if you are using our Sites, services, or goods from a country other than the country in which our servers are located, your communications with us may result in the transfer of information across international boundaries. By visiting the Sites or using any services and communicating electronically with us, you consent to such transfers. You also consent to the processing and transfer of information in and to the USA and other countries.

 

INFORMATION FROM INDIVIDUALS UNDER THE AGE OF 13

Our services, goods, and Sites are not directed to children under age 13. If you become aware that your child has provided us with information without your consent, you should contact us using the details below. If we learn that PII has been collected from a child under 13, then we will delete such information from our files as soon as possible.

 

CHANGES TO PRIVACY POLICY

This Privacy Policy is subject to occasional revision. We reserve the right to make changes to this Privacy Policy at any time without prior notice. If we make any material changes in the way we use your PII, we will notify you by sending you an email to the last email address you provided to us and/or by prominently posting notice of the changes on our website. Please note that you are always responsible for updating your PII with your most current email address. If the last email address that you have provided us is  invalid or for any reason incapable of delivering the notice described above to you, our release of the email containing such notice will constitute effective notice of the changes described in the notice. If you do not wish to permit changes in our use of your PII, you must notify us prior to the effective date of the changes that you wish to deactivate your account with us. Continued use of our services, goods, or Sites following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of them.
